OpenAI has introduced a new feature in the United States that allows ChatGPT to connect directly to bank accounts, credit cards, and financial wallets, providing personalized analysis and suggestions based on the user’s actual financial situation.
But what are the implications when an artificial intelligence system provides incorrect financial information? And, above all, who can be held liable for any damages suffered by users?
In an interview with La Stampa, our Founding Partner Andrea Puccio explained that “Language models are subject to errors and the well-known phenomenon of ‘hallucinations’, responses that appear plausible but are factually inaccurate, which, in the financial sphere, could translate into misleading or incorrect guidance. The question therefore arises as to whether, and to whom, liability can be attributed for any damages caused to users, considering that such erroneous information would not be produced by natural persons, but rather by software systems that lack legal personality and legal responsibility.”
