“No criminal offence”. The way the “ddl Ferragni” works – Andrea Puccio interviewed by Il Giornale

On Il Giornale, Andrea Puccio was interviewed by Francesca Galici about the “ddl Ferragni”, the decree, approved by the Council of Ministers, which aims to make communication about charitable operations clearer and more transparent and which will affect the work and behaviour of influencers and companies.

Andrea Puccio explains that the decree aims to regulate the phenomenon by regulating the sector, without introducing new criminal offences.
However, the ddl has not neglected the criminal aspects, “in fact, on the subject of sanctions, paragraph 2 of Article 4 provides for the exclusion clause: unless the fact constitutes an offence“, the lawyer explained.

In Andrea Puccio’s opinion, it would be “necessary to think about a common discipline, at least at the European Union level, identifying, first of all, a perimeter of legality for the benefit of all players operating in the market. Only once this has been done can administrative and criminal sanctions be envisaged“.
