Lawyers alongside companies in complying with new whistleblowing obligations

Whistleblowing: as of yesterday, for companies with at least 50 employees, the obligations to activate the protected channels of communication for reporting offences and violations foreseen by the new legislation have been triggered.

Massimiliano Carbonato conducted an investigation for Il Sole 24 Ore, asking some criminal lawyers how companies are adapting to the legislation, now that it has become compulsory to manage and follow up each report within the terms defined by the legislator, implementing appropriate tools to guarantee the confidentiality of the whistleblower and then communicating the results of the investigation.

According to Andrea Puccio, ‘It may be necessary to make use of external experts, in any case, the main purpose of the investigation conducted is to ascertain the validity of the facts reported. Therefore, the consultancy should highlight whether it is necessary to strengthen the internal control system and then create an internal compliance system’.
