Whistleblowing: the new legal framework introduced by Legislative Decree 24/2023

In fact, last March 10th, 2023, Italy has finally completed the process of adoption of Directive (EU) 2019/1937 of the European Parliament and of the Council of October 23, 2019, on the protection of persons who report breaches of Union Law, with the approval of Legislative Decree No. 24/2023.

The final text, published in the Official Gazette on March 15th, 2023, varies partially from that of the Draft Decree, adopted on December 9th of last year, and takes into consideration the remarks made to the previous wording by the Parliamentary Committees on “Justice” and “Public and Private Labor” and Confindustria, with a view to better balancing opposing needs: on the one hand, to recognize adequate protections for individuals reporting breaches of a certain gravity and relevance, and, on the other, to preserve companies from economic and reputational damage resulting from distorted uses of whistleblowing means.
